Electric Lantern LLC respects copyright and expects the people who use To Do Machine to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, and we terminate the accounts of repeat infringers.
REPORTING INFRINGEMENT
Send a written notice to our Designated Copyright Agent:
- Lukas Thoms, Electric Lantern LLC
- 418 Broadway, STE N, Albany, NY 12207, USA
- Phone: [to be added before publication]
- Email: dmca@todomachine.com
Under 17 U.S.C. §512(c)(3), your notice must include substantially the following:
- (1) A physical or electronic signature of the copyright owner or someone authorized to act for them.
- (2) Identification of the copyrighted work you say was infringed — or, if there are several, a representative list.
- (3) Identification of the material you say is infringing, with enough information for us to locate it. Please give the exact share link.
- (4) Your address, telephone number, and email address.
- (5) A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- (6) A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
If your notice is incomplete, we may not be able to act on it, and we may ask you for more information.
WHAT WE DO WHEN WE RECEIVE A NOTICE
We review it, and if it is valid we remove or disable access to the material, usually promptly. We tell the person who published it what we removed and why, and we give them a copy of your notice, including your contact details, so they can respond. We record the notice against their account.
COUNTER-NOTIFICATION
If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to the agent above. Under 17 U.S.C. §512(g)(3), it must include substantially:
- (1) Your physical or electronic signature.
- (2) Identification of the material that was removed, and where it appeared before it was removed.
- (3) A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- (4) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the district where you live — or, if you are outside the United States, of any district where Electric Lantern LLC may be found — and that you will accept service of process from the person who filed the original notice, or their agent.
If we receive a valid counter-notification, we will forward it to the person who sent the original notice and let them know we will restore the material in 10 to 14 business days, unless they tell us they have filed a court action seeking to stop you from doing the thing they complained about.
MISREPRESENTATIONS
Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys' fees. Please think carefully before sending either a notice or a counter-notice.
REPEAT INFRINGERS
We have adopted and will reasonably implement the following policy.
- We keep a record of copyright notices we receive about each account.
- An account receives a strike for each item of content we remove because of a valid notice. A strike is withdrawn if the notice is retracted, if we determine it was invalid, or if the user files a valid counter-notification and the material is restored.
- After three strikes we will terminate the account, and we may terminate sooner where the circumstances warrant it. We consider the seriousness of the infringement, whether it appears deliberate, how much time has passed, and whether the user has cooperated.
- We may terminate an account for a single instance of egregious or clearly willful infringement.
- Terminated users may not create a new account. If we find a new account belongs to a terminated user, we will terminate that one too.
- When we terminate an account for repeat infringement, we remove the infringing shared systems from public view and disable them for people who installed them.
If your account was terminated and you believe we made a mistake, contact us at support@todomachine.com.
